Please read these Terms of Service carefully before using the Kilele Cha CBE platform. By creating an account or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using the Kilele Cha CBE platform at kilelechacbc.co.ke ("Platform"), you confirm that you are at least 18 years old (or a legal guardian acting on behalf of a minor), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you may not use our services.
2. Our Services
Kilele Cha CBE provides:
- Career pathway assessments for learners under Kenya's Competency-Based Curriculum (CBC).
- Personalised assessment reports and downloadable PDF certificates.
- Print materials such as handbooks and guides available for purchase.
- Educational content, news, and resources for parents, guardians, and educators.
Assessment results are intended as educational guidance tools, not professional career counselling. We recommend using results alongside advice from qualified educators.
3. Accounts
- You must provide accurate and complete information when registering.
- You are responsible for keeping your password confidential.
- You must notify us immediately if you suspect unauthorised access to your account.
- One account per person. Sharing accounts is not permitted.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Assessment
- Each assessment is linked to a specific learner profile.
- Assessment results are generated by our algorithm and reflect the responses submitted. Accuracy depends on honest and thoughtful responses.
- Results, certificates, and reports are for personal educational use only and may not be resold or presented as professional qualifications.
- A fee is charged to unlock the full assessment report and certificate download. The fee is displayed clearly before payment is initiated.
5. Payments & Orders
- All payments are processed via M-Pesa STK Push powered by Safaricom's Daraja API.
- Prices are displayed in Kenyan Shillings (KES) and are inclusive of any applicable taxes.
- Payments are non-refundable once an assessment report has been accessed or a certificate downloaded, except where required by Kenyan consumer protection law.
- For physical product orders, refunds or replacements are handled on a case-by-case basis. Contact us within 7 days of delivery with any issues.
- We are not responsible for M-Pesa transaction failures caused by network or Safaricom service issues. In such cases, contact us with your transaction reference for assistance.
6. Intellectual Property
All content on this Platform including assessment questions, pathway descriptions, reports, certificates, logos, images, and text is the intellectual property of Kilele Cha CBE or its licensors and is protected by Kenyan and international copyright law.
You may print or download content for your own personal, non-commercial use. You may not reproduce, distribute, or create derivative works without our written permission.
7. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose.
- Attempt to access accounts or data that does not belong to you.
- Disrupt or interfere with the Platform's servers or networks.
- Scrape, crawl, or automate requests to the Platform without written permission.
- Upload or transmit malicious code or harmful content.
- Misrepresent assessment results or use certificates fraudulently.
8. Limitation of Liability
To the fullest extent permitted by Kenyan law, Kilele Cha CBE shall not be liable for:
- Indirect, incidental, or consequential damages arising from use of the Platform.
- Decisions made based on assessment results.
- Temporary unavailability of the Platform due to maintenance or technical issues.
- Loss or corruption of data beyond our reasonable control.
Our total liability to you for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.
9. Termination
You may delete your account at any time by contacting us. We may suspend or terminate your account without notice if you breach these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya. We encourage you to contact us first to resolve any dispute informally before pursuing legal action.
